YOUR AGREEMENT WITH NEXT HORIZON LLC
1. CONSENT TO TERMS AND CONDITIONS.
By using the service of NEXT HORIZON LLC (“NEXT HORIZON” or “our”), you are signifying your agreement and acceptance of these following terms and conditions (“Terms and Conditions” or the “Agreement”), on behalf of yourself and all members of your traveling party. By accessing, using or obtaining any content, products, or services through our offices, company, agent or through our website, you, the purchaser and/or traveler, including all members of your traveling party (the “Customer” and/or “you/your”), agree to be bound by these terms. These Terms and Conditions govern the relationship between NEXT HORIZON and the Customer. No alterations to these terms and conditions may be made by any NEXT HORIZON employee, authorized representative or agent, unless in writing by an authorized officer of NEXT HORIZON.
2. SERVICES.
NEXT HORIZON will provide travel consultation services (the “Services”) to the Customer according to these Terms and Conditions. NEXT HORIZON will use its best efforts, skill and ability in performing the Services under this Agreement. Customer expressly agrees and authorizes NEXT HORIZON to make bookings, reservations and other transactions related to Customer’s travel plans (the “Travel Bookings”) on behalf of the Customer as associated with the Services provided by NEXT HORIZON. Every attempt has been made to include all taxes in your Travel Bookings. In some instances, certain taxes must be paid in cash only, upon arrival to the resort and/or hotel, and may vary in price. Customer is responsible for paying any such taxes. Note: AIRLINE RESERVATIONS SHALL NOT BE INCLUDED IN YOUR TRAVEL BOOKINGS. In such event, it is the Customer’s responsibility to make appropriate air arrangements, as well as transportation to and from the destination where the travel booking originates and returns. NEXT HORIZON shall not assume any responsibility for any air and/or ground schedule changes.
3. USE OF NEXT HORIZON’ SERVICES AND INFORMATION FOR TRAVEL BOOKINGS.
You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to make travel bookings with NEXT HORIZON by any means, including our website in accordance with all terms and conditions herein. You agree to be financially responsible for all of your Travel Bookings (as well as for use of your account by others, including, without limitation, minors traveling with you). You agree to supervise all usage of NEXT HORIZON communications by minors under your name or account. You also warrant that all information supplied by you or members of your household transacting business with NEXT HORIZON is true and accurate. Without limitation, any speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited. You agree that the any type of reservations for travel services provided by NEXT HORIZON shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act. Separate supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. You agree to abide by the terms and conditions of purchase imposed by NEXT HORIZON and any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. You understand that any violation of any such supplier’s conditions of purchase may result in cancellation of your reservation(s) or purchase, in your being denied access to any flights, hotels, cruises, or automobiles, in your forfeiting any monies paid for such reservation(s) or purchase, and in NEXT HORIZON debiting your account for any costs NEXT HORIZON incurs as a result of such violation. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your Travel Bookings made on your behalf by NEXT HORIZON.
4. ROLE OF NEXT HORIZON.
NEXT HORIZON is not the source or supplier of the travel Services and/or Travel Bookings that the Customer has requested and/or authorized, and acts solely as a consultant for the actual suppliers of such services. The Customer has been advised that the suppliers whose names appear in the information supplied to the Customer are those who are actually responsible for providing the travel services the Customer has purchased, including but not limited to those purchases made on behalf of Customer by NEXT HORIZON, and understands and agrees each supplier’s terms and conditions are contained in printed form and/or on their respective websites governing the transaction. The Customer consents to and requests the use of those suppliers and agree not to hold the NEXT HORIZON responsible should any of these suppliers: 1) fail to provide the travel services the Customer has purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes any sort of injury, damage, delay or inconvenience. Because NEXT HORIZON does not have the right to control the operations of the independent operators and their suppliers, NEXT HORIZON IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, which may arise out of these services.
5. RISKS AND SAFETY.
Travel to certain destinations may involve greater risk than others. NEXT HORIZON urges Customer to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, and www.cbp.gov . The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/. By offering travel services to particular destinations, NEXT HORIZON does not represent or warrant that travel to such points is advisable or without risk, and shall not be liable for costs, damages, or losses that may result from travel to such destinations. customer’s participation constitutes acceptance of such events at Customer’s own risk.
6. RELEASE OF LIABILITY.
NEXT HORIZON assumes no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under its control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. NEXT HORIZON has no special knowledge of dangers during travel or at destinations. It is the Customer’s personal decision to travel, and the Customer is doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19 and/or any other pandemic. CUSTOMER HEREBY EXPRESSLY ASSUMES ALL OF THESE RISKS AND DANGERS, AND CUSTOMER HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND NEXT HORIZON’ AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH THE CUSTOMER NOW HAS OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS. NEXT HORIZON cannot be liable for delays in departure or interruption of Customer’s vacation arrangements caused by weather conditions, technical problems of any aircraft, vessel, automotive vehicle or other equipment or instrumentality, strikes, war, terrorist activity, civil commotion or any causes beyond the control of NEXT HORIZON. In no event will NEXT HORIZON be responsible for incidental, consequential or special damage or loss suffered by any person, including but not limited to any person in the Customer’s traveling party. Flâner Travel’s maximum liability, for any reason whatsoever, will be limited to the amount paid to Flâner for its consultant services, not including amount paid to any third-party vendor, supplier or source. In making arrangements for hotel, transport, excursions, or any other type of accommodation, NEXT HORIZON is not acting as principal or as agent for the companies, LLCs, or persons providing or offering the means of transportation and accommodation. NEXT HORIZON shall be deemed to be acting as an agent of the Customer in making the Travel Bookings.
7. DISCOUNTED AND/OR NON-REFUNDABLE FARES.
The Customer agrees to review all Travel Bookings and corresponding travel documents, including without limitation itineraries, confirmations and bookings, for accuracy upon receipt and understand that the Customer may contact NEXT HORIZON if the Customer has any questions. Customer understands that discounted fares typically involve restrictions and that changing any aspect of the Customer’s travel arrangements may result in the payment of additional money. Customer further acknowledges that certain Travel Bookings involve prepayment of a certain percentage and such payment typically is non-refundable. NEXT HORIZON agrees to make known to the Customer when a discounted and/or non-refundable fare is used for any Services.
8. PAYMENTS AND CANCELLATION.
Customer agrees to pay Flâner Services an initial deposit of an agreed-upon amount, at the discretion of NEXT HORIZON, prior to NEXT HORIZON providing any consultation Services and/or making any Travel Bookings. NEXT HORIZON will invoice the Customer for all Travel Bookings made on behalf of Customer and Customer agrees to pay the invoice (“Invoice”) within 7 (seven) days. The Customer shall be responsible for payment of Travel Bookings and all travel costs and charges associated with NEXT HORIZON’ Services, including, without limitation, penalties, waivers, cancellation charges, void processing fees and penalty fares incurred, as well as the cost of lost ticket applications, ticket copies and ticket usage verifications, unless same is incurred as a result of the negligence or misconduct of the NEXT HORIZON. The Invoice will include a separate service charge (the “Service Charge”) for NEXT HORIZON’ consultation services. Customer shall make payment of Invoice in accordance with the date provided in the Invoice. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and any deposit shall be forfeited. The Customer will pay interest on any overdue accounts at a rate of 5% per annum calculated monthly from the due date to the date of payment. At all times, once NEXT HORIZON has expended reasonable efforts in making Travel Bookings and/or performing actions related to NEXT HORIZON’ Services, the Service Charge is non-refundable. Any cancellation of Travel Bookings will be subject to NEXT HORIZON’ and third party supplier’s cancellation penalties. Customer shall have the right to terminate or cancel all or part of the Services by giving NEXT HORIZON thirty (30) days’ prior written notice of its intent to so terminate or cancel. NEXT HORIZON will refund you 100% of the amount the supplier refunds to us, less a 5% cancellation fee per Travel Booking. Customer acknowledges that certain Travel Bookings may be non-refundable and cancellation of such Travel Bookings will still incur an invoice charged to the Customer for the amount that is non-refundable. Travel Bookings that are non-refundable cannot be cancelled or changed. Customer expressly agrees to pay to NEXT HORIZON for any non-refundable portions of the Travel Bookings event in the event that the Customer cancels the trip. Fees and penalties from suppliers vary and are separate. All cancellation fees charged by the supplier and/vendor will be charged back to the Customer, or deducted from Customer’s refund, if Customer is eligible for a refund. Such cancellation fee will be in addition to NEXT HORIZON’ cancellation fee. The Service Charge is non-refundable and Customer explicitly agrees to pay the Service Charge even in the event of cancellation. All eligible refunds will be refunded within thirty (30) days of receiving the funds from the supplier and/or vendor with whom the Travel Bookings were arranged, or if the funds were not sent to the supplier, the funds shall be returned within thirty (30) days after cancellation.
9. TRAVEL DOCUMENTS.
It is the responsibility of each Customer to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. NEXT HORIZON strongly recommends that you take into account that certain countries will not admit a passenger, if their passport expires within six (6) months of the date of entry. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities. Non-United States citizens may require additional documentation. See help.cbp.gov/app/answers/detail/a_id/268/kw/travel and check with your local embassy or consulate. The US Customs and Border Protection Agency requires that for USA child groups under age 19 arriving by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent must be provided to the supervising adult/Group Leader.
10. INDIVIDUAL ENTRY AND EXIT REQUIREMENTS.
Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. (See travel.state.gov/travel/cis_pa_tw/cis/cis_4965.html) NEXT HORIZON feels it is an invasion of privacy for any member of our staff to make such an inquiry.
11. TRAVEL INSURANCE.
The Customer understands that the Customer may purchase travel insurance to cover certain risks inherent in travel, including without limitations, airline cancellations, the inability to travel due to a medical or personal emergency, etc. The Customer expressly acknowledges that NEXT HORIZON will not provide any travel insurance coverage of any kind to the Customer. It is the Customer’s sole responsibility to purchase travel insurance. NEXT HORIZON recommends that the Customer purchase travel insurance as this can help protect you from financial loss. NEXT HORIZON is not responsible for cancellation, emergency evacuation, accidents abroad, illness, lost luggage, flight mishaps, weather conditions, volcanic eruptions and thus recommends that you purchase available insurance coverage at an additional charge.
12. REFUND OF UNUSED ARRANGEMENTS.
No refund will be provided for any unused portion of any Travel Bookings.
13. ALTERATIONS TO CONFIRMED BOOKINGS.
If you decide to change any portion of your confirmed arrangements for any Travel Bookings less than 20 days prior to departure, NEXT HORIZON will attempt to assist you at an administrative charge of $100.00 per change. Alterations in itinerary may be necessitated for any number of reasons, including but not limited to severe weather, availability, at the sole discretion of NEXT HORIZON and subject to each third-party supplier’s terms and conditions. If a property, supplier, activity, or area is deleted for any reason, it may be replaced with a comparable one.
14. GENERAL PROVISIONS.
This Agreement shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles. Any dispute arising out of or relating to this Agreement shall be resolved through binding arbitration in Missouri in accordance with the rules of the American Arbitration Association. You waive any right to bring a class action claim. If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect. All references to monetary amounts in this Agreement shall be to United States Dollar currency. These Terms and Conditions constitute he entire agreement between the Customer and NEXT HORIZON with respect to Travel Bookings made with NEXT HORIZON by any means accessing such information, including its’ website, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Customer and NEXT HORIZON with respect to communications with NEXT HORIZON, including NEXT HORIZON website. Any rights not expressly granted herein are reserved.
By booking a trip with NEXT HORIZON, you acknowledge that you have read, understood, and agreed to these General Terms and Conditions.
Group Trip Terms and Conditions
YOUR AGREEMENT WITH NEXT HORIZON
The following Group Trip Terms and Conditions (the “Group Trip Terms and Conditions” or the “Agreement”) apply to any group trip booked with NEXT HORIZON LLC (“NEXT HORIZON,” “we,” “us,” or “our”) and/or any influencer host (“Host” or “Hosts”). By booking a trip with NEXT HORIZON, you (“you,” “your,” or “Traveler”) acknowledge that you: (i) are at least 18 years of age; (ii) have read, understand, and accept this Group Trip Terms and Conditions; and (iii) are entering into a legally binding contract with NEXT HORIZON.
1. Price Policy and Payments.
1.1. Invoicing and Payment. All group trip prices are as posted on the NEXT HORIZON website and/or Instagram account at the time of booking. Prices are per person and based on double occupancy unless stated otherwise. Single rooms may be available for an additional cost as specified at booking. Prices are subject to change before booking without prior notice. A non-refundable, non-transferable deposit (amount determined at NEXT HORIZON’ sole discretion) is required to secure your spot. Payments may be made via online bank transfers or credit card.
1.2. Trip Deposit. Your deposit payment signifies your acceptance of this Group Trip Terms and Conditions. Upon receipt and processing of your deposit, NEXT HORIZON will confirm your reservation via email. Additional emails or social media messages may be sent with further trip details and final payment due dates. Transaction fees may be added to each payment. If a payment is not received by the due date, we may cancel your reservation, impose a $5 USD per-day late fee, and/or assign your spot to another traveler without refund.
1.3. Payment Schedule. NEXT HORIZON reserves the right to establish the payment schedule at its sole discretion, and you agree to adhere to it.
2. Trip Changes.
NEXT HORIZON reserves the right to make changes to any and all aspects of the trip (which may include without limitation changes to the types and/or timing of activities available during the trip, items and/or services included with the trip, accommodation, the itinerary, and/or the nature of the trip) if, in NEXT HORIZON’s sole discretion, NEXT HORIZON deems it necessary to do so due to conditions that may be hazardous, dangerous, or otherwise adverse or threatening, if an act or omission of a third party prevents any such aspects of the trip or any portion of the trip, or for any other reason considered necessary by NEXT HORIZON. You shall not be eligible for any refunds of any amounts based on any such changes to NEXT HORIZON.
3. Cancellations/Refunds.
3.1. By NEXT HORIZON. NEXT HORIZON reserves the right to cancel your reservation if your full payment is not received on or before the payment due date specified in the email, message, and/or payment link, and you will not be eligible for any refunds of any amounts. NEXT HORIZON further reserves the right to cancel the trip prior to the departure date in the event an insufficient number of registrants are confirmed for the trip or for any other commercial reason in NEXT HORIZON’s sole discretion and, in such an event, you will receive a full refund of the amount you paid to NEXT HORIZON, but in no event will NEXT HORIZON be responsible for any other amount, including preparation costs, airfare, travel documents, or any other losses or claimed damages. NEXT HORIZON may cancel or reschedule a trip for any reason. In the event a trip is cancelled, NEXT HORIZON will refund the amount received from you. NEXT HORIZON will put in reasonable effort to reschedule the trip. In the event a trip is postponed, you will be notified and any payments made will roll over to the new trip dates. NEXT HORIZON may also offer refunds, aside from deposit, for postponed trips on a case-by-case basis. NEXT HORIZON will not be responsible for any additional costs, or any fees incurred by you due to the cancellation or rescheduling of a trip. The cost of airline tickets or other travel arrangements, not made by NEXT HORIZON shall be the sole responsibility of the traveler.
3.2. By Host. For all group trips hosted by an influencer or celebrity (“Host”), Hosts are in contractual agreement to put in reasonable effort to ensure their trip launches as promised. Within said agreement, they have confirmed they will be in reasonable health and availability throughout the official trip dates. If the Host is prevented (directly or indirectly) from performing any of its obligations under this agreement by reason of any Act of God, sickness, strike, trade dispute, fire, inclement weather, breakdown, health or any other pandemic, interruption of transportation networks/means, government or political action, acts of war or terrorism, acts or omissions of a third party, or for any other cause whatsoever outside of NEXT HORIZON’s reasonable control, NEXT HORIZON will be under no liability whatsoever to you. NEXT HORIZON will provide guests the opportunity to attend a trip without the Host but shall not offer refunds if a Host is no longer able to attend.
3.3. Confirmation of Group Trip. Group trips with NEXT HORIZON are automatically confirmed to happen once posted onto our website. The only exception to this would be group tours hosted by influencers as Hosts. Hosts are required to secure a minimum of 6 persons for their trip to be confirmed. In the chance the minimum number is not secured, the group trip will not be confirmed and will not move forward.
3.4. By Traveler. All cancellation requests by Traveler must be in writing and emailed to NEXT HORIZON at the contact email address (hello@flanertravels.com). Refunds are subject to the following terms:
a) If cancellation occurs within one week of payment of any remaining balance that is not the initial deposit, a refund minus a 4% penalty fee (excluding the initial deposit) may be issued.
b) If cancellation occurs more than 120 days before the trip start date, a refund of payments made, minus the initial deposit and 4% penalty fee, will be issued.
c) If cancellation occurs within 120 days of the trip start date, no refund will be issued.
d) All initial deposits to secure your spot are non-refundable.
4. Exclusion from Trip Price.
Unless otherwise stated, the following are not included in the trip price: airfare; airline baggage fees; passports, visas, and vaccinations; gratuities; laundry; telephone charges; minibar; alcohol, beverages, and food outside of contracted menus; optional excursions; porterage; travel insurance; and personal expenses. Any personal expenses at accommodations or restaurants shall be settled by you before departure from the accommodation or restaurant.
5. Air Arrangements to Trip Destinations.
Travelers must purchase their own airline tickets to the trip destination. NEXT HORIZON will not arrange air transportation and shall not be responsible or liable for a traveler’s airfare, airline ticket, or air travel arrangements. All issues with your air travel shall be resolved with the respective airline on which you are ticketed. In the event the airline cancels, reschedules, or delays a flight for any reason or you miss your departure flight or connection, no refunds will be provided by NEXT HORIZON for missed portions of the trip. You are fully responsible for any additional expenses you may incur prior to joining the trip if you miss your departure flight or connecting flight. NEXT HORIZON strongly suggests that all travelers to purchase travel insurance with provisions to cover these unexpected expenses.
6. NEXT HORIZON utilizes various accommodations such as hotels, Airbnb, villas, and bed-and-breakfasts to house travelers during a trip.
Each trip will vary in terms of the accommodations used. Shared room accommodations, with twin/single beds, will be provided (double, triple or multiple bedded rooms). Single room accommodations may be available at an additional charge and must be requested at the time of booking. Room and bed preferences are not guaranteed. Check-in times vary worldwide. NEXT HORIZON cannot control or guarantee check-in times.
7. Optional Excursions.
Optional excursions offered by local operators or third parties may be available during your trip. These excursions are completely independent of NEXT HORIZON and the Host and are not included as part of the official NEXT HORIZON itinerary. If you choose to book an optional excursion:
a) You enter into a contract directly with the local provider and are subject to their terms and conditions, including any liability waivers.
b) NEXT HORIZON and/or the Host shall not be responsible or liable for any aspect of the optional excursion, including its safety, quality, or execution, even where NEXT HORIZON and/or the Host advertises, suggests or assists with booking an optional excursion with the third-party or local operator.
c) Any advice or assistance on or with any optional excursions provided by any local representative does not mean or imply that the option is sold, supervised, or controlled by NEXT HORIZON, or that any such advice or assistance is given on behalf of NEXT HORIZON.
We encourage travelers to review the terms and conditions of any excursion provider before booking.
8. Discount Codes.
Unless advised otherwise any and all discount codes are available for one time use and only for deposit bookings. Discount codes are not guaranteed.
9. Language Use
All tour directors, local hosts, and guides utilized by NEXT HORIZON primarily communicate in English. Traveler should be able to speak, read and understand English.
10. Health and Fitness Eligibility.
You represent that you are over the age of eighteen (18) and are in good physical and mental health, capable of participating in the trip and its activities. You further confirm that you do not have any medical conditions, disabilities, or other impairments that would prevent or limit your safe participation in the trip. You acknowledge that you have consulted a qualified physician regarding your fitness for travel and participation in physical activities and that you have received medical clearance if required. NEXT HORIZON reserves the right to request medical documentation at its discretion. You agree to notify us immediately of any medical condition that arises before or during the trip that may affect your participation. You further acknowledge that the trip may take place in remote areas with limited access to medical services, and you assume all risks associated with such conditions.
YOU ACKNOWLEDGE AND UNDERSTAND THAT ALL MEDICAL AND EVACUATION EXPENSES, INCLUDING THOSE ARISING FROM EMERGENCIES OR PRE-EXISTING CONDITIONS, ARE YOUR SOLE RESPONSIBILITY. YOU ARE REQUIRED TO PURCHASE TRAVEL INSURANCE WITH COVERAGE SUFFICIENT TO MEET YOUR INDIVIDUAL NEEDS.
NEXT HORIZON reserves the right, at its sole discretion, to deny or discontinue your participation in the trip or any related activity if we determine that your health, fitness, or behavior poses a risk to yourself or others.
11. Authority to Refuse or Remove Traveler.
NEXT HORIZON reserves the right, at its sole discretion, to refuse a traveler’s participation in a trip or remove a traveler from an ongoing trip if their behavior negatively impacts the experience, safety, or well-being of others. This includes, but is not limited to, travelers who:
a) Pose a danger to themselves or others.
b) Engage in or threaten to engage in behavior that is, including but not limited to, disruptive, verbally abusive, physically abusive, harassing, discriminatory, violent, or otherwise inappropriate behavior that affects the safety, security, comfort, or enjoyment of other travelers, Hosts, or NEXT HORIZON representatives.
c) Fail or refuse to follow instructions, policies, or procedures set by NEXT HORIZON or the Host.
If a traveler is denied participation or removed from the trip, NEXT HORIZON and/or the Host may leave them at any destination without liability for accommodations, transportation, meals, medical care, or any other expenses incurred thereafter. No refunds will be issued for any portion of the trip, and the traveler may be held responsible for any additional costs incurred by NEXT HORIZON and/or the Host as a result of their removal.
12. Underage Travelers.
NEXT HORIZON requires travelers to be 18 years of age or older to book a trip and travel alone.
13. Visas and Passports.
International travel requires a passport. You must verify all requirements and obtain a passport and all necessary visas for the trip, including all health requirements if any. If you are refused entry into any country for failing to meet the entry and exit requirements, NEXT HORIZON will not be liable.
14. Wi-Fi and Data.
Wi-Fi and/or data availability during your trip is not guaranteed. If available, service may be slow, intermittent, or disrupted. NEXT HORIZON is not responsible for providing Wi-Fi or internet data access.
15. Assumption of Risk.
You acknowledge that travel and participation in trip activities involve inherent risks, including but not limited to accidents, illnesses, injuries, and death. As stated above, the trip may take place in a remote location where there is little or no access to traditional medical services or hospital facilities for serious and/or particular health issues. You may also be visiting places where the political, cultural, and geographical attributes of the location present risks and physical challenges that are greater than those present in your country of residence. It is your own responsibility to familiarize yourself with all possible relevant travel information in connection with your participation in the trip. Understanding and in full consideration of the foregoing, you agree to solely and exclusively assume full and complete responsibility for and the risks inherent in travel and attending the group trip and engaging in physical activity which may include injury, death, property damage, and/or any other kind of liability, whether foreseen or unforeseen, which may occur during your participation in the trip. You acknowledge that your decision to participate in the trip is made in full consideration of the foregoing information and that you solely and exclusively assume the risks involved with participating in the trip.
YOU ARE HEREBY ADVISED THAT THE TRIP MAY TAKE PLACE IN REMOTE AREAS WHERE THERE IS LITTLE OR NO ACCESS TO TRADITIONAL MEDICAL SERVICES OR HOSPITAL FACILITIES FOR SERIOUS HEALTH ISSUES (OR YOUR PARTICULAR HEALTH ISSUES). BY PARTICIPATING IN THE TRIP, YOU VOLUNTARILY AND EXPRESSLY ASSUME ALL ASSOCIATED RISKS AND RESPONSIBILITIES, WHETHER FORESEEN OR UNFORESEEN, INCLUDING INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LIABILITY.
16. Injury and Medical Expenses.
In the event of injury or medical emergency, you agree to assume all financial obligations related to medical care, treatment, evacuation, and associated costs. You acknowledge that NEXT HORIZON is not responsible for providing or arranging medical care and that we are not liable for any resulting damages or expenses. You acknowledge and agree that IN NO EVENT SHALL NEXT HORIZON AND/OR THE HOST AND/OR ANY PARTY RELATED TO NEXT HORIZON BE LIABLE OR RESPONSIBLE FOR ANY LOSSES OR LIABILITIES ARISING OUT OF YOUR PARTICIPATION IN THE TRIP.
17. Waiver of Liability and Release.
In consideration for participating in the trip, YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR AND HEREBY RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, AND COVENANT NOT TO SUE NEXT HORIZON, ITS OFFICERS, MEMBERS, AGENTS, CONTRACTORS, EMPLOYEES, VOLUNTEERS, GUIDES, AND OTHER REPRESENTATIVES (each a “NEXT HORIZON party” and collectively, the “NEXT HORIZON parties”) FOR ANY AND ALL CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, AND/OR LOSSES (including but not limited to any exemplary, direct, indirect, incidental, special, consequential, punitive, or other damages, medical expenses, lost wages/income, loss of services, lost profits, property damage, pain, illness, and death) (collectively “Liabilities”) WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO YOUR TRAVEL TO AND/OR PARTICIPATION IN THE TRIP AND/OR ANY ACTIVITIES CONDUCTED IN CONNECTION THEREWITH, REGARDLESS OF WHETHER SUCH LIABILITIES ARE CAUSED BY THE NEGLIGENCE OF ANY COMPANY PARTY OR OTHERWISE, AND REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ANY COMPANY PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LIABILITIES, TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW. You are required to obtain travel insurance to cover against Liabilities resulting from trip cancellation or interruption, weather, natural disaster, strike, illness, job reasons, accident, sickness, evacuation, pre-existing medical conditions, baggage delay, loss, theft, and other Liabilities associated with travel and your participation in the trip. You acknowledge that whether or not you elect to purchase or not purchase travel insurance, you will not look to any of the NEXT HORIZON parties for reimbursement for any Liabilities suffered or occurring during your travel and/or participation in the trip.
YOU ACKNOWLEDGE THAT THIS WAIVER IS BINDING UPON YOU, YOUR HEIRS, EXECUTORS, LEGAL REPRESENTATIVES, AND ASSIGNS.
18. Travel Insurance.
NEXT HORIZON strongly suggests that You purchase comprehensive travel insurance to cover trip cancellation, medical emergencies, evacuation, accidents, lost baggage, and other liabilities. You acknowledge that NEXT HORIZON is not responsible for any losses, and whether or not you purchase travel insurance, you agree not to seek reimbursement from NEXT HORIZON or its affiliates for any expenses or damages incurred, even if you elect not to purchase travel insurance. By signing up and making any payment to us, you acknowledge this.
19. Health & Safety.
NEXT HORIZON prioritizes traveler safety but cannot eliminate all risks associated with travel. Travelers may encounter unforeseen circumstances such as extreme weather, health issues, political unrest, crime, accidents, or other potentially dangerous situations. By booking a trip, you acknowledge these risks and agree not to hold NEXT HORIZON and/or the Host liable for any harm, injury, or loss sustained during the trip.
Additionally, NEXT HORIZON and/or the Host are not responsible for the quality or availability of medical care. It is your responsibility to:
a) Be aware of health requirements and recommended precautions for your destination.
b) Carry all necessary vaccination records, medications, and personal health information.
c) Review your local government’s travel advisories and vaccination requirements before booking.
Failure to present required vaccination documentation may result in denial of entry into a destination country.
20. Force Majeure.
NEXT HORIZON shall not be liable for any failure or delay in performing its obligations under this Agreement due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, travel restrictions, wars, strikes, political unrest and government actions. If a trip is postponed due to a force majeure event, payments may roll over to a rescheduled trip, but refunds are not guaranteed.
21. Third-Party Providers.
NEXT HORIZON is an independent limited liability company acting as an intermediary for trips that include services provided by third-party suppliers. These third-party suppliers are not employees, agents, or partners of NEXT HORIZON but operate under separate contracts. All third-party services are subject to their own terms and conditions, as well as the laws of the country in which they operate. These terms are available upon request. By booking a trip, you agree that NEXT HORIZON, the Host, and its representatives are not liable for any damage, loss (including personal injury, death, or property damage), or expenses resulting from the actions or omissions of any third-party service provider. If, after departure, any part of the itinerary cannot be fulfilled due to circumstances beyond the control of NEXT HORIZON and/or the Host, reasonable efforts will be made to provide comparable alternative services. Any additional expenses incurred as a result will be the traveler’s responsibility.
22. Limitation of Liability.
To the fullest extent permitted by law, NEXT HORIZON, its affiliates, Hosts, directors, employees, and agents shall not be liable for any claims, injuries, damages, losses, delays, additional expenses, or inconveniences caused directly or indirectly by:
a) The actions, omissions, or negligence of another traveler or third-party provider beyond NEXT HORIZON’s control.
b) Events classified as force majeure (unforeseeable circumstances such as natural disasters, political instability, or other extraordinary occurrences).
c) Any other event outside of NEXT HORIZON’s reasonable control.
This limitation of liability applies to NEXT HORIZON and its affiliates, including guest Hosts, directors, officers, and agents. Where liability cannot be excluded by law, NEXT HORIZON’s responsibility will be limited to the minimum remedies required under applicable law. Any costs or fees specifically designated as your responsibility remain your obligation.
23. Inquiries After the Trip.
If you experience an issue during your trip, please inform NEXT HORIZON and/or the Host as soon as possible so we can address it promptly. Any complaints related to NEXT HORIZON, the Host, or third-party service providers must be submitted to NEXT HORIZON within five (5) days after the trip’s completion. Failure to do so will result in forfeiture of any compensation or resolution that may have otherwise been available. No compensation or resolution is guaranteed.
24. Photographs and Media.
Images displayed on the NEXT HORIZON website are intended as general representations of potential accommodations and attractions; actual experiences may vary. During some trips, NEXT HORIZON may hire a photographer or ask the Host to capture moments of the journey, including travelers, activities, and destinations. By booking a trip, you grant NEXT HORIZON and the Host permission to use any photos taken of you by our photographer or the Host for marketing purposes, including on our website and social media, and the Host’s social media. NEXT HORIZON may, at its discretion, offer these photos to travelers as part of the trip or for an additional fee. If you upload personal photos to the NEXT HORIZON website or upload link, you grant NEXT HORIZON and the Host a perpetual license to use them for promotional purposes.
25. Privacy Policy.
By using the NEXT HORIZON website and booking a trip with NEXT HORIZON, you consent to NEXT HORIZON’s use of your personal information. You acknowledge and agree that by purchasing a trip with NEXT HORIZON, you consent to NEXT HORIZON transmitting your personal information to our third-party suppliers, as necessary. You acknowledge that you have reviewed and agreed with the NEXT HORIZON Privacy Policy.
26. Choice of Law and Dispute Resolution.
This Agreement shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles. Any dispute arising out of or relating to this Agreement shall be resolved through binding arbitration in Missouri in accordance with the rules of the American Arbitration Association. You waive any right to bring a class action claim.
27. Attorneys’ Fees.
Each party shall bear its own attorneys’ fees, costs, and expenses related to any dispute, claim, or legal proceeding arising out of or related to these Terms and Conditions, the trip, or any services provided by NEXT HORIZON. Neither NEXT HORIZON nor the traveler shall be entitled to recover attorneys’ fees or legal costs from the other party, regardless of the outcome of any dispute or proceeding, except where expressly required by applicable law.
28. Severability.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
29. These Group Trip Terms and Conditions may only be amended, modified, or waived by an authorized representative of NEXT HORIZON.
Any such changes must be made in writing. NEXT HORIZON reserves the right to update or modify these Terms and Conditions at any time. You are encouraged to check the NEXT HORIZON website for the most recent version before booking your trip.
30. Entire Agreement.
These Group Trip Terms and Conditions constitute the entire understanding between you and NEXT HORIZON and supersedes all prior agreements. No oral representations or modifications shall be valid unless in writing and signed by both parties.
By booking a trip with NEXT HORIZON, you acknowledge that you have read, understood, and agreed to these Group Trip Terms and Conditions.
